The following are our Terms and Conditions:
All the prices showed on this website are in New Zealand Dollars. Our prices from this website can differ from the prices at the store, and prices displayed on the Top Mobile website are subject to change without notice.
Prices for items on an order are fixed once your order has been accepted. Subsequent price changes either up or down will not be retroactively applied to accepted orders.
In-store payment methods: Cash, Eftpos, MasterCard, Visa. ***There is no additional charge for credit card payments.***
Please be aware that stock availability is for reference only. Stock levels are not updated live, as a result some items may be out of stock at the time of ordering. If this does happen, we will endeavour to source the product for you as fast as possible. Stock levels vary between the stores and the website.
As there is a store in Auckland, it is advisable that you call the store directly to check the availability of a product to avoid disappointment or a wasted trip.
If we determine that we do not have a particular Product in your order in stock, then we will use reasonable endeavours for 30 days to order the relevant Product ("Back Ordered Products"). In this instance, we will notify you of the relevant Back Ordered Products and the anticipated delivery date.
If a back order has been placed for an item that we cannot source we will notify you and will provide you with a prompt refund.
Payment for Backorders is required at time of ordering, if paying by internet banking, payment is required within 3 working days.
- We endeavor to dispatch packages for stock items as soon as referenced payments are cleared.
- All goods are sent via a 'Signature required courier' so you must provide a physical address where someone is available during the day to sign for your delivery.
- We cannot deliver to a PO Box address or any address in which we deem suspicious.
- Please allow us up to 3 working days to process your transaction and send the goods. If the order is urgent, please follow up the order with a phone call.
- We take no responsibility for lost, damaged or stolen goods, or goods that have been delivered to an incorrect address. Whilst we endeavor to ensure that the stated delivery times are kept, due to variables outside of our control, we cannot guarantee that the goods will arrive as per the stated delivery times.
- Deliveries to Rural areas and Waiheke Island can take up to an additional 2 working days.
- Goods ordered on Friday (after 1pm), Saturday and Sunday will only be shipped on Monday.
- If a parcel is not received within 5 working days from the shipment date, we need to be notified immediately; otherwise we take no responsibility for the loss of the item. Please be aware that items are not delivered/processed on weekends or public holidays.
- If the item is not in stock, we will endeavour to contact you as soon as we possibly can and organize for a suitable solution.
Layby options are available through our store. If you wish to place an item on lay by, you must contact at our store in Papatoetoe.
Layby items are held for 4weeks from the date of purchase. The minimum deposit is 20%, and the final payment must be made within 4 weeks. If final payment is not completed within the 4 weeks, the item will be returned to stock, the buyer being no refunded as per our layby cancellation.
Top Mobile Ltd will fulfill all of our obligations under the Consumer Guarantees Act 1993.
All our products carry a 12 Months manufacturer warranty excluding the parts for repair and accessories listed below. And for phones under $100 dollars we only provide three months warranty.
Consumable parts and accessories including Batteries, Chargers, Headsets, Cables, Memory cards etc. and all repair parts carry a one month warranty.
Your tax invoice or receipt is your proof of purchase for any warranty claim.
Return postage of faulty items is the responsibility of the Buyer-no exceptions (RTB Warranty). The warranty will be applied on the manufacturer defect only, not for user's misusage.
Extended warranty is also available on selected items through Top Mobile at the time of purchase in store. The Warranty conditions also apply to the Extended Warranty.

Statutory Warranties - Consumer Guarantees Act
If you have purchased goods or services for domestic or household use you may have rights under the Consumer Guarantees Act 1993.
If you have purchased goods or services for business or commercial purposes the Consumer Guarantees Act will not apply.
General Returns - 7 Day Money Back Guarantee
You can return an item for a full refund within 7 days providing the device is in the same condition it was in when purchased i.e. Brand New. Once an item has been used it cannot be returned for a refund. Items must be returned with all included accessories and packaging. You MUST have the original receipt for a refund, without this receipt we will not refund the item. We do not sell used items and will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser.
All returns are subject to inspection by ourselves and/or our service department.
Returned products must be in the same condition as received including all packaging and accessories, items must be completely unused.
Faulty items will be covered under our Warranty Policy.
Due to our constantly fluctuating prices, refunds will be given at the original price on the receipt.
Refunds will not be issued if it has been more than 7 days since the date of purchase.

What if I received an incorrect product?
If the item is incorrect, please contact our Customer Services team immediately at firstname.lastname@example.org. Please provide your tracking number at the time of contact.
Warranty & Repair
Our warranty works on a Return To Base basis. This means that should a fault occur with your product, it will need to be returned to us for assessment.
Once we have received an item, we will book the item in and send to an independent service agent for assessment. All items are repaired if possible, if a repair is not possible or feasible, we will arrange a replacement item. All service items are subject to a $20 deposit payable at the time of booking item in. This deposit will be refunded should the item be repaired or replaced under warranty. Should the item be found to be non-warranty, this deposit is kept as an assessment fee and will not be refunded.
The warranty will carry on from the initial date of purchase. The assessment and repair process can take 7-15 working days. Some delays may occur if there is a shortage of parts. Any repair/replacement comes with a 30 days warranty.
The original receipt is required for a warranty claim.
The Warranty applies if
The device and its accessories are handled properly for the intended use, in accordance with the operating instructions.
The device has failed due to faulty parts within the warranty period.
The Warranty may not apply and the device may not be repairable if
There is Liquid/Moisture damage.
Damage caused by unreasonable use, including but not limited to impact damage, power surge, misuse or neglect.
There is evidence of repair or tampering by an un-authorized person.
The device has been damaged during rough handling, exposure to harsh environments (including extreme temperatures, leaving in direct sunlight, excessive dust or signs of physical damage).
The fault is caused by corrupted Software (Due to full memory, installation of third party software/applications or boot loader unlocking or otherwise).
The fault occurs outside the warranty period.
The fault is normal wear and tear of the device.
All service items are subject to a $20 deposit payable at the time of booking the item in.
The Assessment Bond is refundable if
The device is within the warranty period.
The device fault is covered under warranty.
The Assessment Bond will NOT be refunded if
There was no fault found.
The fault is not covered under warranty.
The device is outside the warranty period.
What is liquid damage?
Liquid damage refers to any signs of corrosion that may be present in the device on a printed circuit board, component or user interface. In some cases, the liquid damage may not be visible to the naked eye but can be detected with the use of a professional microscope. Liquid damage causes "Latent damage" to the circuitry. This means that although the device may appear to be operational, there is internal degradation to the circuitry which may result in a failure.
Possible causes of liquid damage may include but not limited to
Immersion in liquid.
Exposure to steam.
Condensation (When moving from a cool or air-conditioned environment into a warmer, humid environment).
Data Loss warning for Electronic device repairs
Electronic devices may lose some or all the user software settings and data in the process of assessment, diagnosis and repair and these might not be recoverable. It is your responsibility to back up data prior to booking in the device for assessment.
Top Mobile and the repair agents take no responsibility for loss of data stored should it occur during assessment and/or repair or for any other consequential personal or business loss including but not limited to goodwill, wasted expenditure.
All products not picked up within 50 days of being advised, will become the property of the repairer. This could be disposed of, used for spare parts to recover repair costs.
We respect your privacy. We collect, hold and use your personal information in accordance with the Privacy Act 1993. We will collect your personal information through your personal contact with us. Any personal information that is provided by the user is retained by Top Mobile Ltd for the purposes of contact and shipping only and will not be distributed to third parties.
Prices, specifications, and images are subject to change without notice. Top Mobile Ltd is not responsible for typographical or illustrative errors. (All images on our website are for reference purposes only). If you are unsure as to an items colour etc. or would prefer a specific colour, please call or email prior to placing your order.
We reserve the right to limit quantities per customer on certain items that may be on special. We will attempt to place a note on the items concerned; however we reserve the right to cancel orders placed on limited items.
If you are unsure as to whether an item will suit your needs or not, please contact us before purchasing. It is the responsibility of the customer to ensure the item will suit their needs and an verbal advice given by Top Mobile staff should be followed up by further research and due diligence by the customer.
Top Mobile attempts to be as accurate as possible. However, Top Mobile does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Top Mobile is not as described, your sole remedy is to return it in unused condition.
Changes to these terms and conditions
For future orders, these terms may be different and so we recommend that you read these terms carefully each time you agree to them during the ordering process.
We will not change any terms and conditions for an existing order that has been accepted by us, the terms and conditions that will apply to the order, are the terms and conditions that applied at the time you place your order.
